Terms and conditions

Welcome to FG Guitars. These Terms & Conditions (“Agreement”) constitute a legal agreement between you (“User,” “Member”) and FG Guitars (“we,” “our,” “us”). By accessing or using our website, tutorial content, subscription services, or community features (collectively, the “Services”), you agree to be bound by this Agreement. If you do not agree, you may not access or use the Services.

1. Eligibility

By using the Services, you represent that:

  • You are at least 13 years old (or the minimum legal age in your jurisdiction).
  • You have the legal capacity to enter into this Agreement.
  • You will comply with all applicable laws while using the Services.

2. Subscription Services

  • Subscription Term: Access to tutorials and the community is granted for a 3-month period (“Quarterly Subscription”), unless otherwise specified.
  • Renewal: Subscriptions automatically renew for successive 3-month periods unless canceled before the renewal date.
  • Payments: Fees are billed in USD. All payments are due in advance. No refunds are provided for partial periods, except as required by law or special promotions.
  • Non-Transferable: Subscriptions are for personal use only and may not be shared or transferred.
  • Cancellation: You may cancel at any time through your account settings or by contacting our support at fredgbcn@gmail.com. Cancellation takes effect at the end of the current billing period.

3. Account Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized use of your account.
  • You may not share your account or grant access to others.

4. Acceptable Use & Community Rules

By using our Services, you agree not to:

  • Post or share content that is illegal, offensive, harassing, discriminatory, sexually explicit involving minors, or infringes third-party rights.
  • Use the Services for commercial purposes without permission.
  • Attempt to hack, scrape, or disrupt our Services or servers.
  • Impersonate another person or create multiple accounts for abuse.

We reserve the right to remove, restrict, or suspend any content or accounts violating these rules.

5. Intellectual Property

  • All tutorials, videos, music exercises, text, images, and other materials are owned by FG Guitars or its licensors.
  • You are granted a personal, non-exclusive license to access the content for learning purposes.
  • You may not redistribute, sell, or publicly share our content without written permission.
  • Any feedback or submissions you provide grant us a perpetual, royalty-free license to use or modify for our business purposes.

6. Payment Disputes & Fraud

  • We may withhold or deduct access or payments in case of suspected fraud, abuse, or violation of these Terms.
  • All billing disputes must be submitted within 90 days of the charge.

7. Limitation of Liability

  • Services are provided “as is”. We do not guarantee results, uninterrupted access, or error-free operation.
  • We are not liable for indirect, incidental, special, or consequential damages, or for losses exceeding the total subscription fees paid in the preceding 2 months.

8. Indemnification

You agree to indemnify, defend, and hold harmless FG Guitars, its affiliates, and employees against any claims, damages, or expenses arising from:

  • Your use of the Services.
  • Violations of this Agreement.
  • Violation of any law or third-party rights.

9. Third-Party Links & Content

  • Our Services may contain links to third-party websites. We are not responsible for content, products, or services from these third parties.
  • Your use of third-party services is at your own risk.

10. Privacy

By using the Services, you agree to our Privacy Policy, which governs the collection, use, and disclosure of personal information.

11. Termination

We may modify, suspend, or terminate access to the Services at any time for any reason, with or without notice. Termination does not release you from obligations accrued prior to termination.

12. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of France, without regard to conflict of law principles.
  • Arbitration Option: We encourage disputes to be resolved informally. You may opt for arbitration if desired.
  • Any legal claims not subject to arbitration shall be filed in the courts of Strasbourg, France.

13. Changes to Terms

We may modify these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
